The South by Southwest festival is held every spring in Austin, Texas. Earlier this year, a drunk driver went through a barricade, striking several people in a crowd at the event. Four people died and another two dozen were injured.
The organizers of the popular music festival have been named as plaintiffs in the lawsuit, as has a traffic design consultant. According to one of the lawsuits, “A festival organizer or traffic design consultant of ordinary intelligence would have anticipated the danger.”
The driver has been jailed since the tragedy. The lawsuits allege that the organizers should have taken greater care after increased arrests in the past few years for DWI and public drunkenness. The driver had a blood alcohol concentration of .114, which is above the state’s limit of .08.
One of the victim’s attorneys said that the only way to make the festival organizers more apt to make changes is to hold them accountable for their failures. If not, according to the attorney, then there really is no reason or incentive for changes to be made. The 2015 South by Southwest festival is already planned for the middle of March.
The family members of those who died in this tragedy and the victims who suffered all types of injuries can seek compensation from the people or entities that are responsible.
