Woman files lawsuit in crash with dump truck

A 19-year-old college student has filed a lawsuit against Franco's Trucking company and one of its dump truck drivers. The woman was seriously injured when the truck smashed into three vehicles in West Austin a few weeks ago.

The lawsuit alleges that the driver of the dump truck did not keep a proper lookout or control of the vehicle and operated the vehicle in a manner that was unsafe. In addition, the lawsuit alleges that the trucking company was negligent when they hired the driver, who has more than one conviction for DUI and is a "twice-convicted felon." According to the woman's attorney, "Bottom line is that truck should not have been on the road and that driver should not have been driving that vehicle."

According to the lawsuit, the dump truck "began to bounce and [the driver] was forced to pull over to the side of the road." The driver started down the road again, eventually crashing into the plaintiff's car and two other vehicles. The lawsuit states that the woman suffered from spinal injuries and glass embedded in her ears and face.

The Federal Motor Carrier Safety Administration has 20 violations over the last two years for the truck company. There is also a record of a crash last year. Some of the violations that the FMCSA has on file include inoperative headlights, turn signal and taillights, as well as no inspection for a commercial vehicle and a grease or oil leak. None of these violations require immediate action by the driver or trucking company.
