The number of drunk driving fatalities in Texas are the highest in the nation, according to Mothers Against Drunk Driving. Statistics given by MADD for 2013 show that 1,337 people lost their lives because of drunk drivers. This doesn't account for the thousands of people who suffered injuries because of intoxicated drivers. A recent car vs. pedestrian accident in McKinney, Texas, left a 9-year-old girl with a concussion. The driver of the vehicle, a 54-year-old man, has been charged with possession of less than two ounces of marijuana, intoxicated assault with a vehicle and driving with an invalid license. According to police, the child was attempting to cross Louisiana Street at a crossing when the accident occurred. The driver was interviewed by a local news station while in custody and said that he was not drinking to get drunk. The man said he was hung-over from drinking all weekend and had a 16-ounce Busch beer that morning in order to "take away the rip and roar in [his] head." He told the reporter, "... he didn't believe it impacted his reaction." The man said he took a blood test and a breathalyzer test, but the results of the tests have not been released. Police are still investigating the accident. The 9-year-old is at home recovering from the concussion she suffered in the accident. When someone causes injury or death in a drunk driving accident, he or she may be held accountable in criminal court. However, injured victims and the family of those who have died may also file a civil suit against the driver. The claims may include those for medical expenses, mental distress, pain and suffering and more.
