Families of young women on bus allege driver and company were negligent
A horrific bus and truck crash in Oklahoma in September has resulted in two lawsuits being filed in Tarrant County, according to the Dallas Morning News. The crash, which happened when a truck struck the bus head on, led to the deaths of four young women who were returning to their college in Gainesville after a softball match in Oklahoma. The families of two of the girls on the bus are accusing both the truck driver and his employer of negligence.
Bus and truck accident
The accident occurred Sept. 26 in Oklahoma just north of the Texas border. For reasons that have yet to be determined, the truck crossed the grassy median and collided with the bus carrying the softball team, which was headed south back towards Texas. Police say the truck crossed the median at 70 mph without braking or swerving. The driver initially told police that he had been distracted by something inside his truck.
Bloomberg News later reported that a marijuana pipe and a number of prescription drugs, some of which have side effects that cause fatigue, were also found in the truck. Although police say that the driver did not appear inebriated at the scene, investigators are awaiting the results from blood samples taken from him.
Legal action launched
The accident killed four young women and required hospital stays for two more. The families of two of those women, one who passed away and one who was seriously injured, are now suing both the truck driver and the trucking company. Although the crash occurred in Oklahoma, they filed their lawsuits in Tarrant County where the truck driver lives. They allege that the driver was negligent and distracted leading up to the crash.
Furthermore, they accuse his employer of being negligent in hiring him. Both lawsuits are seeking a trial by jury and $1 million in damages. The family of the deceased woman has also filed a wrongful death claim, while the family of the woman who was injured say that her injuries are likely permanent. Authorities are still investigating the accident.
Serious motor vehicle accidents, especially when they involve large trucks, can result in catastrophic injuries and sometimes, as the above case sadly shows, death. Unfortunately, some crashes are also the result of negligent or reckless behavior on the part of one of the drivers or even a third party.
Anybody who has been injured by the alleged negligence of another person should get in touch with a personal injury attorney as soon as possible. An experienced attorney can provide compassionate, valuable, and dedicated counsel for people still coping with the devastating aftermath of a serious car accident.
