When your children are playing outside, you rely on the fact that you have taught them to pay attention to vehicles passing through the neighborhood. You also teach them to stay out of the roadways. For one girl in Fort Worth, Texas, that advice still didn’t keep her safe.

According to witnesses, the driver of the SUV struck some parked vehicles on another street before turning the wrong way onto a divided roadway. The accident involving the child was on Barrel Run. The girl was reportedly walking on the sidewalk when the SUV came up off the roadway and slammed into her. After striking the girl, the SUV slammed into a tree and then a brick wall. Police have since charged the 28-year-old woman with intoxication assault.

The girl was transported to Cook Children’s Medical Center by helicopter for leg and head injuries. News reports did not list her current condition. The driver of the vehicle was also taken for medical care. She was transported by ambulance for non-life threatening injuries.

When a child is injured by a drunk driver’s actions, criminal charges may not bring the feeling of justice that the family wants. It won’t pay for the child’s medical bills either. A civil lawsuit filed against the drunk driver can bring compensation for those medical bills, as well as the child’s pain and suffering and emotional trauma.

When considering whether to file a civil lawsuit, the advice of an experienced personal injury attorney can be invaluable. He or she can ensure that your child’s rights and your rights are protected, as well as pursuing the compensation the family deserves.
